TERMS AND CONDITIONS OF SALE

The Terms and Conditions set forth below pertain to the sale of products by PuriLite (or “we”) to the customer (herein called “you” or “customer”). PuriLite’s sale of products to the customer is governed by the acceptance of these Terms and Conditions.   

Amendments/Applicable Law
These terms and conditions of sale may be amended at any time by PuriLite. These conditions, your access to and use of the Website, and all related matters are governed solely by the laws of Ontario, Canada.


Limited Warranty/Defective Products 

All products other than Larson Electronics Products. 
In no event is PuriLite or any of its subsidiaries or affiliates be held liable for any indirect, special, incidental, punitive or consequential damages including but not limited to loss of use, loss of data, loss of business or loss of profits to the extent permitted by law. In the event of any issue with a product that you have purchased through PuriLite, you agree that your sole remedy, if any, is from the manufacturer of such product, in accordance with such manufacturer’s warranty, or to seek a return and refund for such product in accordance with PuriLite’s return policy.

The only warranties applying to products sold are those, if any, specifically provided by the manufacturer and are to be honored by the manufacturer. You acknowledge and agree that PuriLite is a distributor and not a manufacturer, and all applicable product specifications, representations and warranties are solely those of the manufacturer of the product sold. PuriLite makes no warranties, express or implied, and disclaims all other warranties, including without limitation implied warranties of merchantability, fitness for a particular purpose and conformity to models or samples. Manufacturers’ warranties for exported products may vary or may be null and void for products exported or transported outside Canada.


Larson Electronics products 
Larson Electronics warrants each unit to be free of defects in materials and workmanship for a period of three (3) years from the date of purchase. If the unit should malfunction, it must be returned to the Larson factory for evaluation. PuriLite’s Sales Department will issue a Returned Merchandise Authorization (RMA) number upon phone or email request. Upon examination by Larson Electronics, if the unit is found to be defective it will be repaired or replaced at no charge. 

Larson Electronics’ warranty does not apply to defects resulting from any action of the purchaser, including but not limited to mishandling, improper interfacing, operation outside of design limits, improper repair, or unauthorized modification. This WARRANTY is VOID if the unit shows evidence of having been tampered with or shows evidence of being damaged as a result of excessive corrosion; or current, heat, moisture or vibration; improper specification; misapplication; misuse or other operating conditions outside of the manufacturer’s control.
PuriLite and Larson Electronics neither assumes responsibility for any omissions or errors nor assumes liability for any damages that result from the use of its products in accordance with information provided by Larson Electronics, either verbal or written. Larson Electronics warrants only that the parts manufactured by it will be as specified and free of defects.

Force Majeure
PuriLite is not be liable for any delay in, or impairment of, performance resulting in whole or in part from any force majeure event, including but not limited to acts of God, labour disruptions, acts of war, acts of terrorism (whether actual or threatened), governmental decrees or controls, insurrections, epidemics, pandemics, quarantines, shortages, communication or power failures, fires, accidents, explosions, inability or delays in procuring or shipping product or obtaining permits and licenses, inability in procuring supplies or raw materials, severe weather conditions, catastrophic events, or any other circumstance or cause beyond the reasonable control of PuriLite in the conduct of its business.

 

Pricing Policy
Prices are subject to change without notice. All prices are in Canadian dollars. PuriLite is not responsible for typographical errors. In the event a product is listed at an incorrect or out-dated price or with incorrect information due to typographical errors or error in pricing or product information received from our suppliers or due to the passage of time or change in market conditions, PuriLite reserves the right to refuse or cancel any orders placed for product listed at the incorrect or out dated price. PuriLite shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, PuriLite will promptly issue a credit to your credit card account in the amount of the charge.
Prices displayed in print catalogues or online PDFs are for reference purposes only. For accurate pricing please verify your products online. 
Quotations on large quantities are available on request.

Orders
With prior notice to the customer, PuriLite reserves the right at any time after receipt of your order and prior to shipment to change the estimated delivery date and/or decline or cancel your order.


Payment Terms
Payment for PuriLite’s products or services will be made by credit card unless the credit terms have been agreed to by PuriLite. Invoices are due and payable within the time period noted on the invoice. 
At PuriLite’s discretion, purchases may be made through Visa® or MasterCard® at the time of purchase. We do not accept American Express credit cards for purchases.  PuriLite offers financing options on a case by case basis, subject to credit checks.

Product availability
Products are subject to availability at time of order.

Product Misuse
Should any Product(s) be misused in any way, PuriLite assumes no responsibility as set forth in our basic WARRANTY / DISCLAIMER language, and additionally purchaser will indemnify PuriLite and hold PuriLite harmless from any liability or damage whatsoever arising out of the use of the Product(s) in such a manner.

PuriLite Online Gift Card Policy
PuriLite Gift Card. Terms and conditions: Redeemable at PuriLite Online Shop only. Gift card program conditions: By activating and/or using this gift card, you agree to the terms and conditions specified herein, which may be modified by PuriLite without notice in accordance with applicable laws. This card can be used, up to its total value in Canadian dollars, to make payments for purchases. This card cannot be converted into cash, is non-refundable (except in Quebec, where any balance of $5 or less can be refunded upon request by consumer), and cannot be used to make payments on a line of credit or credit card account, to purchase other gift cards. PuriLite may not be held responsible for replacing or honoring this card if lost. This card is not subject to any fees and has no expiry date. About Equipment Lease-to-own
We understand that the success of your business is ensuring you have access to the latest technology and product. We also understand that businesses have capital constrains which cannot enable them to purchases expensive products upfront which is why we introduced our Lease-to-own program.
PuriLite’s Equipment Lease-to-own program provides companies with the ease of purchasing products on an easy monthly instalment. PuriLite uses a third party leasing company to provide its customers a seamless way to lease a product. The best part is, at the end of the term, you can return the product, or purchase it for either 10% of the purchase price or $1. Lease-to-own options are available for any product on the PuriLite store with a purchase value of $1,000 or greater. To determine if your purchase qualifies, please contact us at info@purilite.ca.

Recycling Fees
Buyer shall bear all applicable recycling fees including all electronic waste recycling fees to be remitted by PuriLite under any provincial electronic waste recycling program. If Buyer desires to remit applicable electronic waste recycling fees directly to any
provincial electronic waste recycling program on PuriLite’s behalf, Buyer is responsible for providing PuriLite with confirmation of its registration status and, if applicable, entering into the online agreement with the provincial electronic waste recycling program and PuriLite prior to shipment.
